Terms of Service
These terms apply when you use the Train Watch website, app, phone notifications or email alerts (the "service"). The service is operated by [OrbitLink Consulting, LLC] ("we", "us"). By signing up or using the service, you agree to these terms.
1. What Train Watch does
Train Watch sends alerts when a freight train is likely blocking Sullivan St, Shelton Rd, or Slaughter Rd in Madison, Alabama, and follow-up alerts when a crossing appears clear again.
2. Alerts are estimates
No public real-time train feed exists for these crossings. Train presence is inferred from traffic data, railroad radio and City of Madison notices. An alert can be wrong, late, or missing entirely, and a "clear" alert does not mean a crossing is safe to cross.
- Always obey crossing signals, gates, signs and law enforcement. Never rely on Train Watch to decide whether it's safe to cross railroad tracks.
- Don't read or interact with alerts while driving. Check them before you leave or when safely stopped, or let a passenger check.
- Train Watch is not an emergency service. In an emergency, call 911.
3. The pilot and future pricing
Train Watch is currently a no-charge pilot. We ask pilot users for feedback on the train information and the service. We do not collect payment details during the pilot.
We intend to make Train Watch a paid service. Before any charge, we'll email you the price and terms, and you won't be charged unless you separately agree to a paid plan. Active pilot users will receive a priority discount, and users whose invitees sign up may receive an additional discount. The amounts and conditions of both discounts will be set out when paid plans are announced.
Email alerts are a paid-plan feature. Pilot users may use them free during the pilot. When the pilot ends, email alerts continue only on a paid plan; phone notifications are not affected.
4. Your account
- Use an email address you control. Sign-in codes are sent there.
- You're responsible for activity on devices where you stay signed in.
- You may delete your account at any time in the app's Settings.
5. Acceptable use
Don't misuse the service. That includes trying to access other people's accounts or our systems, overloading the service, sending false reports, or reselling or republishing alerts in bulk without our permission.
6. Not affiliated
Train Watch is an independent service. It is not affiliated with, endorsed by, or operated by Norfolk Southern, the City of Madison, or any railroad or government agency.
7. Changes to the service and these terms
We may change, pause or end the service, including the pilot, at any time. If we change these terms in a meaningful way, we'll update the date above and email account holders before the change takes effect. Continuing to use the service after that means you accept the updated terms.
8. Ending your use
You can stop using Train Watch and delete your account at any time. We may suspend or close accounts that break these terms.
9. Disclaimer
The service is provided "as is" and "as available", without warranties of any kind, express or implied, including accuracy, timeliness, availability, merchantability, or fitness for a particular purpose.
10. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for delays, missed appointments, lost time, or any other loss arising from an alert that was wrong, late or missing, or from your use of the service. Our total liability for any claim is limited to the amount you paid us for the service in the 12 months before the claim (during the free pilot, that amount is $0).
11. Governing law
These terms are governed by the laws of the State of Alabama. Any dispute will be handled in the state or federal courts serving Madison County, Alabama.
